THESE ARE THE MINUTES OF A COMMON COUNCIL MEETING OF THE 27TH COMMON COUNCIL, HELD AT 7:45 P.M., TUESDAY, JUNE 19, 2007, IN THE COUNCIL CHAMBERS OF BROOKFIELD CITY HALL, 2000 N. CALHOUN ROAD, BROOKFIELD, WISCONSIN

 Mayor Jeff Speaker called the Common Council to order at approximately 7:45 p.m.   The next Common Council meeting will be July 17th.

 Economic Development Coordinator Pat Drinan presented the First Quarter 2007 Featured Business Award to Linda Kiedrowski, President/Owner, of The Paranet Group, Inc. 

 One person spoke during the 15 minute segment set aside for citizens to address the Council regarding the elimination of the sidewalk on the eastside of Lilly Road (item #28 on the agenda).

Alderman Bill Carnell led the Council in the Pledge of Allegiance.


 ACTIONS OF THE COMMON COUNCIL

 A public hearing was heard regarding the request of the Pines of Brookfield LLC to rezone lands from “M-1” Multiple family Residential district to “M-2” Multiple family Residential district located at 18615 W. Burleigh Road to facilitate construction of 6 condominium units.  (Separate minutes were taken for the public hearings.)

CONSENT AGENDA

 Alderman Berg moved approval of the items on the Consent Agenda, except for Item #4.  The motion was seconded by Alderman Franz and carried unanimously.  Recorded as a roll call.

 1)         Minutes from the Regular Common Council meeting of June 5, 2007.

 Actions and recommendations of the Plan Commission minutes of June 11, 2007, including the Plan Review Board minutes of May 17, 2007

 2)         P.C. #1:  Plan Review Board recommendations of May 17, 2007:

                        a.  PRB #1:  Colonial Heights Condominium Association and Stone Creek Development to approve a Development Agreement for the Colonial Heights Condominium Addition located at 18550 thru 18650 Kamala Court, permitting construction of 6 additional dwelling units.

                        b.  PRB #2:  Brookfield Lutheran Church, 18500 W. Burleigh Rd., for approval of a revised plan and method of operation permitting modifications of building materials associated with an approved addition to the existing church.

                        c.  PRB #3:  Irgens Development Partners, c/o Zimmerman Architectural Studios Inc., for approval of a revised plan and method of operation permitting modifications to building materials associated with an approved change of use at 13800 W. North Ave.

3)         P.C. #2:  CBL and Associates Properties for approval of exterior building modification to a previously approved plan and method of operation for the construction of a 22,500 sq. ft. specialty grocery store to be located at the southeast corner of Bluemound Road and Main Street (15875 W. Bluemound Road).

4)         Removed from the Consent Agenda.

5)         P.C. #4:  Department of Community Development to schedule a public hearing for the purpose of establishing permanent zoning of “R-2” Single-family Residence District, “C” Conservancy District, “NSW” Non-Shoreland Wetland Overlay District and “FF” Flood Fringe Overlay District on lands annexed to the City from the Town of Brookfield via Ord. #2010-05 and #2083-06 with a temporary zoning of “R-2” Single-family Residence District and a portion with Shoreland Protection Overlay District.

6)         P.C. #5:  Plan Commission approval to schedule a public hearing amending Chapter 17, the Zoning Code, permitting outdoor seating for restaurants located in the “O&LB” Office and Limited Business district subject to Plan Commission approval of a plan and method of operation.

 27)       Items removed from the Consent Agenda:

 4)         P.C. #3:  CBL and Associates Properties for approval of a plan and method of operation for the construction of one restaurant – Claim Jumper – (9,776 sq. ft.) as an addition to the Brookfield Square Mall, Brookfield Square Phase VI.

 The Plan Commission recommended approval of the plan and method of operation and increased F.A.R. (44.4% increased to 45.25%) for the property, as supported with the rationale stated above, subject to the conditions listed in the staff report, and: (1) Remove the blinds/shutters on the first floor windows; (2) Use frosted glass on one first floor window previously shown as being completed shuttered; (3) Reduce the colors on the palette by using one wood stain color and change green colored shutters to match stucco color; (4) Construct the service “wing wall” out of the same stone used in the building; (5) Leave the extended timbers as originally proposed; and (6) Work with staff on the design and appearance of the windows on the faux second story by deepening the sills, adding detail, use clear glass, etc.

 Alderman Mahkorn moved adoption of the Plan Commission recommendation.  The motion was seconded by Alderman Owen and carried unanimously.


Board of Public Works

 28)       Discussion and possible action regarding consideration of deleting sidewalks on the east side of Lilly Road as part of the Burleigh/Lilly Road project.

 Alderman Sutton moved to remove the construction of the sidewalk from the eastside of Lilly Road as part of the Burleigh/Lilly Road project until a further date as determined by the City.  The motion was seconded by Alderman Blackburn and carried Ayes 8, Nays 6 with Aldermen Reddin, Owen, Garvens, Ponto, Nelson, and Mahkorn voting nay.


Council As A Whole

29)       Legislative Referrals:    

            a.         Alderman Carnell requested the Plan Commission forward comments to the Board of Zoning Appeals relative to an appeal by Kohl’s Department Store, located at 124th Street and North Avenue, of an order dated 10/5/06, requiring the removal of trailers used for storage and as an extension of the store in violation of section 17.52.010 of the municipal code.  Section 17.52.010 requires all activities of a business district be conducted wholly inside a building.

            b.         Alderman Jerry Mellone referred a request to the Board of Public Works for a change in the time frame of the widening of Calhoun Road and a request for an independent traffic study in order to justify the scope of the project, given recent developments on the State Budget and response to answers from WisDOT. (See memo dated June 11, 2007, from Mohammad Hossain from WisDOT.)

            c.         Alderman Blackburn referred to the appropriate committee consideration of a policy to scan, into PDF format, public comments submitted in writing at Public Information Meetings or Public Hearings, where such comments are solicited.  Comments would then be posted to the City Website along with the minutes for the meeting.  The purpose would be to make the information easily retrievable not only by the public, but by Alderman and staff as well.

            d.         Alderman Blackburn referred to either Board of Public Works and/or Plan Commission a request to obtain a traffic impact analysis that includes the projected traffic increase on Brookfield Road, River Road, and Burleigh Road should further zoning changes as indicated by the Village Neighborhood Plan be implanted.  Include whether or not the projected increases will precipitate the need to install traffic lights at the intersections of those roads as well as the intersection of Burleigh Road and Calhoun Road.

29)       Alderman Ponto moved to adjourn.  The motion was seconded by Alderman Mahkorn and carried unanimously.  10:05 p.m.
