Mayor Jeff Speaker called the Common Council to order at approximately 7:50 p.m. The next Common Council meeting will be April 17th .
Five people spoke from the audience during the 15 minute segment set aside for citizens to address the Council regarding the proposed relocation of two fire stations.
Scout Troop 56 from Dixon Elementary School and Troop 183 from Brookfield Academy led the Council in the Pledge of Allegiance.

Alderman Ponto moved approval of the items on
the Consent Agenda, except for Item #2. The motion was seconded by Alderman
Garvens and carried unanimously. Recorded as a roll call.

2) Alderman Makhorn moved approval of Draft Ordinance #13 creating Chapter 17.75 Office and Limited Residential/Commercial District No. 3 (O&LR/C) of the Zoning Code, or the new zoning district that would be applied to properties located at 12501 thru 12935 W. Bluemound Road (TKN’s 1108.144, 1108.136, 1108.137 and CP Rail right-of-way) for purposes of implementing the 124th Street and Bluemound Road Neighborhood Plan. Authorize the schedule of public hearings to adopt the ordinance and to secondly rezone the above properties to said zoning district. The motion was seconded by Alderman Owen.
The Plan Commission recommended approval to schedule a public hearing to consider adding the draft ordinance to the City Zoning Code and authorize a public hearing to apply said zoning to properties located at 12501 thru 12935 W. Bluemound Road or TKN’s 1108.144, 1108.136, 1108.137 and the CP Rail right-of-way, with the amendments as noted: (1) Change the wording of 17.75.020 A.1.d., which currently reads: “More than one floor per building is preferred” to specify that the Plan Commission prefers a two-story building but a developer could present an application for a one-story building but the Plan Commission will decide if that is appropriate or desirable; (2) Change the wording of 17.75.020. A.4, which currently reads: “Gateway. A water feature is intended to be located at the southwest corner of the 124th Street (extended) and Bluemound Road intersection…”. The Plan Commission suggested the wording be changed to say that a gateway feature is intended to be located there, and it may include but is not limited to a water feature; and (3) Allow more than one residence REGULAR COMMON COUNCIL APRIL 3, 2007
per business tenant.
Alderman Blackburn moved to amend 17.75.040 A. Height Regulation from 70 feet maximum to 55 feet maximum. The motion was seconded by Alderman J. Mellone and lost Ayes 3, Nays 11 with Aldermen J. Mellone, L. Mellone and Blackburn voting Aye.
The original motion carried unanimously.

Council As A Whole
12) Alderman Ponto moved approval of the recommendations from the Uniform Fire/EMS Service Delivery Task Force relative to the relocation of two fire stations (to an alignment in the vicinity of Calhoun Road). The motion was seconded by Alderman Reddin. A paper roll call vote was taken and carried Ayes 10, Nays 4 with Aldermen L. Mellone, Carnell, J. Mellone, and Sutton voting nay.

13) Legislative Referrals:
a. Alderman Owen
requested that the Board of Public Works, Water and Sewer Board and Plan
Commission review and update the Subdivision Code (Title 16) of the Municipal
Code.
b. Alderman Berg
requested that the Human Resources & Public Safety Committee review the
Municipal Judge’s salary in-light of increased duties, to be acted on in time
for the next Election in 2008.
