THESE ARE THE MINUTES OF A COMMON COUNCIL MEETING OF THE 27TH COMMON COUNCIL, HELD AT 7:45 P.M., TUESDAY, FEBRUARY 20, 2007, IN THE COUNCIL CHAMBERS OF BROOKFIELD CITY HALL, 2000 N. CALHOUN ROAD, BROOKFIELD, WISCONSIN

ALDERMEN PRESENT: Scott Berg, Gary Mahkorn, Steve Ponto, Dan Sutton, Rick Owen, Christopher Blackburn, Bill Carnell, Bob Reddin, Jerry Mellone, Lisa Mellone, Ron Balzer, Mark Nelson, Mike Franz

Mayor Jeff Speaker called the Common Council to order at approximately 8:00 p.m. The next Common Council meeting will be March 6.

Alderman Lisa Mellone led the Council in the Pledge of Allegiance.

No one spoke from the audience during the 15 minute segment set aside for citizens to address the Council.


 

ACTIONS OF THE COMMON COUNCIL

A public hearing was heard regarding the request of Colonial Heights Condominiums, 18550 thru 18650 Kamala Court, to establish “MSO” Modified Suburban Overlay District – Residential Cluster. (These minutes are separate.) Hearing ended at 8:45 p.m.

Alderman J. Mellone moved approval of the items on the Consent Agenda, except for Item #16. The motion was seconded by Alderman Franz and carried unanimously. Recorded as a roll call.

Actions and recommendations of the Plan Commission minutes of February 12, 2007

• P.C. #2: Gail Picard, 18235 Milwaukee Ave., for a determination by the Common Council

 

upon study and recommendation of the Plan Commission, if Lot 6 of Block 6 of Brookfield Heights subdivision is a separate and buildable lot for purposes of constructing a single-family home thereon. The procedures of Section 17.128.030 of the Zoning Code are being applied to this request. The Plan Commission denied the request.

3) • P.C. #4: Proposed extension of Ordinance No. 2070-06, an extension of Ordinance No. 195804, a Development Moratorium for the Waste Management landfill known as Outlots 1 and 2 of CSM No. 9898 and Outlots 6, 7, 8, 9, 11 and 12 of The Shire subdivision (initially identified as Outlots 6-10) bounding same, not including lots 1-25 of The Shire subdivision.

4) Ordinance continuing a moratorium on development in the area of the Waste Management Landfill and certain Outlots in or associated with The Shire subdivision be extended to September 1, 2008. Ordinance No. 2090-07*

6) Request of the Library to purchase library materials from Baker & Taylor for $80,000.

7) Ordinance amending Sections 3.28.010, 5.04.010 and 12.12.020 of the Municipal Code relative to development fees, yard waste hauler fees, and drainage course fees. Ordinance No. 2091-07*

8) Resolution approving 2007 Wilson Center debt service fund budget amendment requested by the Director of Finance: increase lease revenues and debt principal expenditures for purposes of recognizing final lease obligation payment from the Sharon Lynne Wilson Center for the Arts and related debt repayment. Resolution No. 7687-07*

14) Resolution approving the engineering contract between Earth Tech and the City of Brookfield for conducting traffic impact analysis and engineering design for the extension of Executive Drive from Bluemound Road to Wisconsin Avenue, in an amount not to exceed $150,000. Resolution No.

17) Resolution approving the Perpetual Water Main and Sanitary Sewer Easements between the City of Brookfield and Capitol Imperial LLC (18300 W. Capitol Dr.) Resolution No. 7691-07*

18) Resolution approving the Agreement vacating the Sanitary Sewer & Municipal Utility Easements between Brookfield Square Parcel LLC, Bonstores Realty One LLC (Abuelo’s 15665 W. Bluemound Rd.) and the City of Brookfield. Resolution No. 7692-07*

16) Alderman Berg moved approval of the Resolution affirming the water main extension policy and water main assessment guide. The motion was seconded by Alderman Owen and carried unanimously. Resolution No. 7690-07*

20) Legislative Referrals:

a. Alderman Owen referred to the Human Resources and Public Safety Committee to analyze the Civil Service ordinances for a possible amendment to create more efficient staffing and appeals processes.

21) Alderman Ponto moved to adjourn. The motion was seconded by Alderman Sutton and carried unanimously. 9:05 p.m.
