THESE ARE THE MINUTES OF A COMMON COUNCIL MEETING OF THE 27TH COMMON COUNCIL, HELD AT 8:05 P.M., TUESDAY, SEPTEMBER 5, 2006, IN THE COUNCIL CHAMBERS OF BROOKFIELD CITY HALL, 2000 N. CALHOUN ROAD, BROOKFIELD, WISCONSIN 

MAYOR JEFF SPEAKER PRESIDING

 

ALDERMEN PRESENT:  Scott Berg, Gary Mahkorn, Steve Ponto, Dan Sutton, Rick Owen, Christopher Blackburn, James Garvens, Mike Franz, Bill Carnell, Bob Reddin, Jerry Mellone, Lisa Mellone, Ron Balzer, Mark Nelson

 

ALDERMEN ABSENT & EXCUSED:  None

 

ALSO PRESENT:  Acting City Attorney Karen Flaherty, Director of Administration Dean Marquardt, City Clerk Kristine Schmidt, Director of Finance Robert Scott, Director of Community Development

 

Mayor Jeff Speaker called the Common Council to order at approximately 8:05 p.m.  The next Common Council meeting will be September 19th. 

 

Dennis Buehler of the Sharon Lynne Wilson Center for the Arts presented their annual report.

 

Alderman Garvens led the Council in the Pledge of Allegiance.

 

No one spoke from the audience during the 15 minute segment set aside for citizens to address the Council. 

           


ACTIONS OF THE COMMON COUNCIL

 

            8:05 p.m. A public hearing was heard regarding the request of the City of Brookfield to create sections in the Zoning Code providing penalties for violations of Development Agreements and Plan and Method of Operations.  The hearing ended at 8:10 p.m. (Minutes of the Public Hearing are separate from Council Minutes.)

 

CONSENT AGENDA

 

Alderman Ponto moved approval of the items on the Consent Agenda.  The motion was seconded by Alderman Owen and carried unanimously.  Recorded as a roll call. 

 

1)         Minutes from the Regular Common Council meeting of August 15, 2006.

 

As recommended by the Finance Committee

 

2)         Vouchers exceeding $50,000 requiring immediate action.

 

3)         Request to deny claims:  (a) Liberty Mutual Insurance (Hong); (b) Thomas Kursel; and (c) Paul Gaspardo.

 

4)         Resolution approving the lease amendment with Cingular Wireless (Brookfield Square site).  Resolution No. 7626-06*

5)         Resolution approving a labor agreement between the City of Brookfield and the Wisconsin Professional Police Association (W.P.A.A.) Clerical Unit regarding the terms of a successor labor agreement covering calendar year 2006 and 2007.  Resolution No. 7627-06*

 

6)         Resolution approving a labor agreement between the City of Brookfield and the Wisconsin Professional Police Association (W.P.A.A.) Clerical Unit regarding the terms of a successor labor agreement covering calendar years 2008 and 2009.  Resolution No. 7628-06*

7)         Initial Resolution regarding Industrial Development Revenue Bond Financing for National Graphics, Inc.  Initial Resolution No. 7629-06*

11)       Mayor's Appointment:

            a.         Parks and Recreation Commission – Corey Golla, Elmbrook School representative, 3 year term expiring 9/5/09.

13)       Legislative Referrals: 

            a.         Mayor Speaker referred to the Legislative and Licensing Committee an Ordinance amending Section 2.16.100 A. and B. and 2.16.110 B. of the Municipal Code relating to distribution of the Ethics Code and the required related interest statement.

 

14)       In continuing actions of the Council, pursuant to 19.85(1) of the Wisconsin Statutes, after first convening in open session, the Mayor will explain the nature of the business proposed to be considered in closed session, and upon a motion duly made, seconded and adopted, meeting in Closed Session for the following purpose:

 

a.   Under 19.85(1)(g) Conferring with legal counsel for the governmental body who is rendering oral or written advice concerning strategy to be adopted by the body with respect to litigation in which it is or is likely to become involved.  (Discussion of strategy with the City Attorney about pending Ravenswood sewer extension lawsuit with the Town of Brookfield related City-Town issues.)

 

Alderman Garvens moved to convene into Closed Session under Section 19.85(1)(g).  The motion was seconded by Alderman Ponto and carried unanimously.  Recorded as a roll call.  8:30 p.m.

 

Present during closed session were as follows:  Mayor, City Clerk, Acting City Attorney, Director of Public Works, Director of Human Resources, Director of Administration, and Director of Finance, Attorney George Schimmel.

15)       Alderman Ponto moved to adjourn the meeting without going into open session.  No action was taken in closed session.  The motion was seconded by Alderman Sutton and carried unanimously.  9:30 p.m.
