THESE ARE THE MINUTES OF A REGULAR COMMON COUNCIL MEETING HELD AT 7:45 P.M., TUESDAY, DECEMBER 4, 2001, IN THE COUNCIL CHAMBERS OF BROOKFIELD CITY HALL, 2000 N. CALHOUN ROAD, BROOKFIELD, WISCONSIN

MAYOR KATHRYN BLOOMBERG IN THE CHAIR

ALDERMEN PRESENT: Daniel Waffenschmidt, Thomas Schellinger, Steven Ponto, Richard Brunner, Jim Garvens, Karl Schulz, Scott Berg, Kari Clappier, Brad Steinke, Michael Jakus, Gary Mahkorn, Jim Heinrich, Don Bauer, Howard Washechek

ALDERMEN ABSENT & EXCUSED: None

Mayor Bloomberg called the meeting of the Common Council to order at approximately 8:10 p.m. (A public hearing was heard previously - Illumination Standards.) No citizen wished to speak during the 15 minute public speaking segment.

The next Common Council meeting will be December 18th .


Alderman Don Bauer led the Council in the Pledge of Allegiance to the American Flag.


Alderman Waffenschmidt moved approval of the Regular Common Council minutes of November 20, 2001. The motion was seconded by Alderman Garvens and carried unanimously.


ACTIONS OF THE COMMON COUNCIL

PLAN COMMISSION

The next item was the Partial Plan Commission's actions and recommendations as represented in the Regular Plan Commission's minutes of November 12, 2001, Item #8 - Approval of the "Lilly Road and Capitol Drive Neighborhood Plan: Node Land Use and Transportation Plan", as prepared by the Department of Community Development.

The Plan Commission moved to recommend to the Common Council approval of the "Lilly Road and Capitol Drive Neighborhood Plan: Node Land Use and Transportation Plan".

Alderman Schulz moved to adopt the recommendation of the Plan Commission. The motion was seconded by Alderman Jakus and carried unanimously.


Alderman Schulz moved approval of the Resolution adopting the "Lilly Road and Capitol Drive Neighborhood Plan: Node Land Use and Transportation Plan" and incorporating the plan as an additional element in the City's Master Plan. The motion was seconded by Alderman Jakus and carried unanimously. Resolution No. 6829*


PLAN COMMISSION/LEGISLATIVE COMMITTEE - Alderman Schulz/Jakus, Chairman

Alderman Schulz moved adoption of the Ordinance repealing and recreating Section 17.120.70 of the Municipal Code relating to Illumination. The motion was seconded by Alderman Jakus.

Alderman Berg moved to table the ordinance and refer it back to Plan Commission for further discussion. The motion was seconded by Alderman Mahkorn and carried unanimously.

Alderman Berg had been contacted by a resident who stated his concern about the costs imposed by this ordinance. On further investigation, Alderman berg found other technical problems with the proposal. See: Lighting Ordinance


ECONOMIC DEVELOPMENT/FINANCE COMMITTEE - Alderman Garvens, Chairman

Alderman Garvens moved to table the Resolution supporting the funding for the City of Brookfield Economic Development Committee and the Brookfield Convention and Visitor's Bureau, Inc. for year 2002. The motion was seconded by Alderman Schulz and carried unanimously.


FINANCE COMMITTEE - Alderman Garvens, Chairman

Alderman Garvens moved approval of the Vouchers exceeding $50,000 requiring immediate action. The motion was seconded by Alderman Brunner and carried unanimously.


Alderman Garvens moved adoption of the Ordinance amending Section 2.56.110 of the Municipal Code regarding expenses of the City's Emergency Management activities/organization. The motion was seconded by Alderman Ponto. A roll call vote was taken and carried unanimously. Ordinance No. 1837*


Alderman Garvens moved adoption of Item #9, the Ordinance repealing and recreating Chapter 15.04.780 of the Municipal Code, the schedule of permit fees for the Building Code; Item #10, the Ordinance repealing and recreation Chapter 15.12.060 of the Municipal Code, the schedule of permit fees for the Plumbing Code; Item #11, the Ordinance repealing and recreating Chapter 15.08.240 of the Municipal Code, the schedule of permit fees for the Electrical Code; Item #12, the Ordinance repealing and recreating Chapter 8.08.190 of the Municipal Code, the schedule of permit fees relating to Fire Protection and Life Safety Code; and Item #13, the Ordinance repealing and recreating Chapter 8.16.090 of the Municipal Code, the schedule of fees for Fire Prevention Inspection. The motion was seconded by Alderman Heinrich. One roll call vote was taken on all the ordinances and carried unanimously.

Alderman Garvens moved approval of the Resolution authorizing the issuance and sale of up to $3,390,597 Sewerage System Revenue Bonds, Series 2001B (Clean Water Fund loan). The motion was seconded by Alderman Schulz. A roll call vote was taken and carried unanimously. Resolution No. 6830*


Alderman Garvens moved approval of the Resolution accepting COPS MORE01 grant from the U.S. Department of Justice. The motion was seconded by Alderman Ponto and carried unanimously. Resolution No. 6831*


Alderman Garvens moved approval of the Resolution amending 2001 Debt Service Fund budget, requested by the Director of Finance: appropriate $30,000 from debt service fund balance to account #103-908-584-000, Interest on General Obligation Notes, for purposes of paying interest on 2001 debt. The motion was seconded by Alderman Heinrich and carried unanimously. Resolution No. 6832*


Alderman Garvens moved to deny the Notice of Claim from Louis R. Ceman. The motion was seconded by Alderman Brunner and carried unanimously.


Alderman Garvens moved approval of the Resolution approving the Agreement for legal services between Attorney E. Joseph Kershek and the City of Brookfield in prosecuting the City's ordinance violations. The motion was seconded by Alderman Heinrich and carried unanimously. Resolution No. 6833*


Alderman Garvens moved approval of the Resolution approving telecommunication leases with Sprint Spectrum L.P. regarding location of telecommunication equipment on the water tower located at 17200 W. Capitol Drive; Public Safety Fire Station, 2100 N. Calhoun Road; and the Brookfield Square site, 127 S. Moorland Road. The motion was seconded by Alderman Brunner and carried unanimously. LEGISLATIVE & LICENSING COMMITTEE - Alderman Jakus, Chairman

Alderman Jakus moved adoption of the Ordinance creating Section 9.28.010 B.5. and to amend Section 12.24.050 C. of the Municipal Code to allow the discharge of weapons as part of the City's Deer Control Program. The motion was seconded by Alderman Waffenschmidt and carried unanimously. Ordinance No. 1843*


WATER BOARD - Alderman Washechek, Chairman

Alderman Washechek moved approval of the Resolution approving the summer water sprinkling policy. The motion was seconded by Alderman Mahkorn and carried unanimously. Resolution No. 6835*


COUNCIL AS A WHOLE

Alderman Jakus moved approval of the Resolution authorizing the submittal of a state grant application and subsequent appropriation of City funds for the Urban Deer Abatement and Control Program. The motion was seconded by Alderman Waffenschmidt and carried unanimously. Resolution No. 6836*


Alderman Jakus moved approval of two Original Bartender Licenses. The motion was seconded by Alderman Schulz and carried unanimously.


Alderman Waffenschmidt moved to adjourn. The motion was seconded by Alderman Ponto and carried unanimously. 9:00 p.m.
