THESE ARE THE MINUTES OF A REGULAR COMMON COUNCIL MEETING HELD AT 7:45 P.M., TUESDAY, NOVEMBER 20, 2001, IN THE COUNCIL CHAMBERS OF BROOKFIELD CITY HALL, 2000 N. CALHOUN ROAD, BROOKFIELD, WISCONSIN

Mayor Bloomberg called the meeting of the Common Council to order at approximately 8:05 p.m.
No citizen wished to speak during the 15 minute public speaking segment. (The 2002 Budget Public Hearing was heard previously.)
The next Common Council meeting will be December 4th . The Common Council meetings in January have been changed to January 8th and January 22nd, which will not conflict with the Plan Commission meetings.
Alderman Dan Waffenschmidt led the Council during the Pledge of Allegiance to the American Flag.
Alderman Waffenschmidt moved approval of the Regular Common Council minutes of November 6, 2001. The motion was seconded by Alderman Brunner and carried unanimously.
ACTIONS OF THE COMMON COUNCIL
PLAN COMMISSION
The next item was the Plan Commission's actions and recommendations as represented in the Regular Plan Commission's minutes of November 12, 2001, excluding Item #8 - Lilly Road and Capitol Drive Neighborhood Plan: Node Land Use and Transportation Plan, and including the Plan Review Board minutes of October 18, 2001.
Alderman Jakus moved approval of the Regular Plan Commission's minutes of November 12, 2001, excluding Item #8 - Lilly Road and Capitol Drive Neighborhood Plan: Node Land Use and Transportation Plan, and including the Plan Review Board minutes of October 18, 2001. The motion was seconded by Alderman Schulz.
There were a number of questions on the Plan Review Board's minutes. The correct location of the entrance signs for the Wimmer project, The Club at Brookfield Hills, should be Moorland & Greenfield, not Calhoun and Greenfield. The sign request for Rainbow Foods at 17295 W. Capitol Drive indicates a previously authorized variance. Questions were asked concerning the reason for the variance as well as which signs the variance pertained to. Mr. Ertl will direct staff to prepare a memo to answer the aldermen's questions.
The motion was carried with the correction to the Plan Review Board minutes of October 18, 2001.
FINANCE COMMITTEE - Alderman Garvens, Chairman
Alderman Garvens moved approval of the Vouchers exceeding $50,000 requiring immediate action. The motion was seconded by Alderman Heinrich and carried unanimously.
Alderman Garvens moved adoption of the Ordinance appropriating the necessary funds and adopting the budgets for the operation of the government and administration of the City of Brookfield for the year 2002. The motion was seconded by Alderman Schulz. A roll call vote was taken and carried unanimously. Ordinance No. 1832*
Alderman Garvens moved adoption of the Ordinance approving the authorized positions for departments of the City of Brookfield for the year 2002. The motion was seconded by Alderman Schulz. A roll call vote was taken and carried unanimously. Ordinance No. 1833*
Alderman Garvens moved adoption of the Ordinance levying property taxes for the General, Wastewater Utility, Special Revenue and Debt Service Funds of the City of Brookfield for the year 2002. The motion was seconded by Alderman Heinrich. A roll call vote was taken and carried unanimously. Ordinance No. 1834*
Alderman Garvens moved approval of the Resolution authorizing investments in the Wisconsin Investment Trust. The motion was seconded by Alderman Heinrich and carried unanimously. Resolution No. 6824*
Alderman Garvens moved adoption of the Ordinance repealing and recreating Section 6.08.090 of the Municipal Code relating to Dog Licenses. The motion was seconded by Alderman Heinrich. A roll call vote was taken and carried unanimously. Ordinance No. 1835*
LEGISLATIVE & LICENSING COMMITTEE - Alderman Jakus, Chairman
Alderman Jakus moved approval of one original bartender license and one the tabled bartender license. The motion was seconded by Alderman Waffenschmidt and carried unanimously.
Alderman Jakus moved approval of the Original Class A Combination Beer and Liquor License for Calhoun Liquor and Wine, 17000 W. Capitol Drive, Jeff Desotell-Agent. The motion was seconded by Alderman Waffenschmidt and carried unanimously.
Alderman Jakus moved adoption of the Ordinance amending Section 15.04.340 of the Municipal Code regarding fences. The motion was seconded by Alderman Waffenschmidt. A roll call vote was taken and carried unanimously. Ordinance No. 1836*
PERSONNEL COMMITTEE - Alderman Ponto, Chairman
Alderman Ponto moved approval of the Resolution regarding the selection of the City's carrier for Workers' Compensation Insurance for calendar year 2002. The motion was seconded by Alderman Waffenschmidt and carried unanimously. Resolution No. 6825*
BOARD OF PUBLIC WORKS - Alderman Schulz, Chairman
Alderman Schulz moved approval of the Resolution agreeing to reimburse the City of Wauwatosa for actual costs to construct storm sewer in N. 124th Street at Congress Street on the Brookfield-side of the City limits, not to exceed $55,650. The motion was seconded by Alderman Jakus and carried unanimously. Resolution No. 6826*
Alderman Schulz moved approval of the Resolution approving the Solid Waste and Recycling Contract with Superior of Wisconsin, Inc. to collect, remove, and dispose of solid waste and recyclable materials, for a base period of four years commencing on January 1, 2002, and ending December 31, 2005. The motion was seconded by Alderman Mahkorn and carried unanimously. Resolution No. 6827*
Alderman Schulz moved approval of the Relocation Order and Resolution of Necessity for acquisition of lands for public purposes, authorizing negotiation for such acquisitions and authorizing condemnation if necessary, for portions of properties located near the intersection of Barker Road and North Avenue - fee simple and temporary limited easements acquisition: 20485 Coventry Drive (M. Pfeiffer Trust); 2330 Chanticleer Drive (J. Chipley); 20270 W. North Avenue (T. & C. Scholl); Outlot 1 CSM #8193 - TKN #1086-996-001 (D. Bartlett). The motion was seconded by Alderman Jakus. A roll call vote was taken and carried Ayes 8, No's 4 with Aldermen Ponto, Berg, Heinrich, and Schellinger voting no. Resolution No. 6828*

COUNCIL AS A WHOLE
Alderman Jakus moved approval of the Mayor's Appointments-Community Development Authority. The motion was seconded by Alderman Garvens and carried unanimously.
Community Development Authority Kathryn C. Bloomberg - Term expires 4/16/02 Gordon Rozmus - 4 year term, resume attached. Michael D. Arneson - 1 year term, resume attached. Brad Steinke - Council Appointment. Term expires 4/16/02, resume attached. Nathan Cunniff - 3 year term, resume attached. Roger Engelking - 2 year term, resume attached.
Alderman Waffenschmidt moved to adjourn. The motion was seconded by Alderman Jakus and carried unanimously. 8:50 p.m.
