THESE ARE THE MINUTES OF A REGULAR COMMON COUNCIL MEETING HELD AT 7:45 P.M., TUESDAY, JUNE 5, 2001, IN THE COUNCIL CHAMBERS OF BROOKFIELD CITY HALL, 2000 N. CALHOUN ROAD, BROOKFIELD, WISCONSIN

MAYOR KATHRYN BLOOMBERG IN THE CHAIR

Mayor Bloomberg called the meeting of the Common Council to order at approximately 8:05 p.m. Betty McGlynn, member of the Police and Fire Commission announced the selection of Interim Police Chief, Dan Tushaus as Chief of Police for the City of Brookfield. Chief Tushaus received congratulations from the Mayor and Council.


A number of residents spoke during the fifteen-minute public speaking segment regarding the jurisdictional transfer of roads to Waukesha County and concerns were heard from Hawks Ridge relative to the Calhoun South Task Force recommendations.


Chairman of the Deer Task Force Charlene Dwyer and Director of Parks and Recreation Bill Kolstad presented a report relative to the status of the Deer Task Force.


Director of Public Works Tom Grisa introduced John Jansen and Greg Bolin from Ruekert & Mielke who presented the results of the Citywide water system study (Lake Michigan water vs. groundwater).


Alderman Mahkorn led the Council in the Pledge of Allegiance to the American Flag.


Alderman Waffenschmidt moved approval of the Regular Common Council minutes of May 15, 2001. The motion was seconded by Alderman Brunner and carried unanimously.


ACTIONS OF THE COMMON COUNCIL

FINANCE COMMITTEE - Alderman Garvens, Chairman

Alderman Garvens moved approval of the Vouchers exceeding $50,000 requiring immediate action. The motion was seconded by Alderman Heinrich and carried unanimously.


Alderman Garvens moved approval of the Resolution approving the 2000 budget transfer requested by the Director of Finance: $125,000 from the Contingency account #101-910-590 to Transfers to Other Funds account #101-910-591 for the purpose of funding retiree sick leave benefits. The motion was seconded by Alderman Heinrich and carried unanimously. Resolution No. 6752*


Alderman Garvens moved approval of the Resolution accepting the 2000 Comprehensive Annual Financial Report (including Single Audit) and related auditor's reports. The motion was seconded by Alderman Heinrich and carried unanimously. Resolution No. 6753*


Alderman Garvens moved to deny the Notice of Claim re: Aegerter. The motion was seconded by Alderman Brunner and carried unanimously.


Alderman Garvens moved approval of the Resolution declaring official intent to reimburse capital expenditures aggregating approximately $3,600,000 for Sanitary Sewer Hot Spot Projects - phase 2. The motion was seconded by Alderman Heinrich and carried unanimously. Resolution No. 6754*


LEGISLATIVE & LICENSING COMMITTEE - Alderman Mahkorn, Acting Chairman

Alderman Mahkorn moved approval of Item #9a, fourteen original bartender licenses and to table one original bartender license; and Item #9c, approval of seven Renewal Bartender Licenses. The motion was seconded by Alderman Waffenschmidt and carried unanimously.


Alderman Mahkorn moved to approve the bartender's license previously tabled by the License Committee. The motion was seconded by Alderman Waffenschmidt and carried unanimously.


Alderman Mahkorn moved approval of Item #9d - Renewal Class A Combination Licenses: Sentry Foods #172, 17295 W. Capitol Drive; Westbrook Beverage Center, 13430 W. Greenfield Ave.; approval of Item #9e - Renewal Class A Malt Licenses: Sentry Foods #213, 17100 W. Greenfield Ave.; and approval of Item #9f - Renewal Class B Combination Licenses: Boulder Junction, 12550 W. Burleigh Road; Castle Inn, 13170 W. Greenfield Ave.; Catering & Cuisine by V. Richards, 21755 Gateway Rd.; Courtyard by Marriott, 16865 W. Bluemound Rd.; Devine's Lariat, 4165 N. 124th St.; Grecian Inn Family Restaurant, 14375 W. Capitol Dr.; Houlihan's Old Place, 95 N. Moorland Rd.; The Loaf and Jug Restaurant, 17700 W. Capitol Dr.; Mr. B's-A Bartolotta Steakhouse, 17700 W. Capitol Dr.; Peach Garden, 2325 N. 124th St.; Pistol Pete's Neighborhood Grill, 16755 W. Lisbon Ave.; Residence Inn, 950 Pinehurst Ct.; Sheraton Milwaukee/Brookfield, 375 S. Moorland Rd.; V. Richards, 17165-C W. Bluemound Rd.; Venice Club, 1905 N. Calhoun Rd.; Westmoor Country Club, 400 S. Moorland Road and to table the licenses for Meadow Inn and Ritter's Inn. The motion was seconded by Alderman Waffenschmidt and carried unanimously. (All license approvals are subject to further administrative approval and payment of all outstanding obligations.)


Alderman Mahkorn moved approval of the Original Class B Combination Beer and Liquor License: Sticks & Stones, 2300 Pilgrim Road; Agent: Daniel J. Powers. The motion was seconded by Alderman Waffenschmidt and carried unanimously.


Alderman Mahkorn moved approval of the Fireworks User Permit for the Brookfield Soccer Event on June 8, 2001, subject to the City Attorney approval of the Certificate of Insurance. The motion was seconded by Alderman Waffenschmidt and carried unanimously.


PERSONNEL COMMITTEE - Alderman Ponto, Chairman

Alderman Ponto moved adoption of the Ordinance amending Ord. #1804, establishing salaries of certain elected officials commencing with their new term of office in April 2002. The motion was seconded by Alderman Garvens. A roll call vote was taken and carried Ayes 12, No's 1 with Alderman Berg voting no. Ordinance No. 1808*

This was the first of many instances when Ald. Berg resisted excessive pay increases for Aldermen.


Alderman Ponto moved approval of the Resolution approving the appointment of City Engineer, Jeffrey Chase. The motion was seconded by Alderman Garvens and carried unanimously. Resolution No. 6755*


BOARD OF PUBLIC WORKS - Alderman Schulz, Chairman

Alderman Schulz moved to remove from the table the Resolution approving the Jurisdictional Transfer Agreement for Lisbon Road, Hampton Avenue, Moorland Road, Barker Road, North Avenue, Calhoun Road and Pilgrim Road. The motion was seconded by Alderman Washechek and carried unanimously.

Alderman Ponto moved to amend the resolution to delete Barker Road from the jurisdictional transfer. The motion was seconded by Alderman Heinrich. A roll call vote was taken and failed Ayes 4, No's 9 with Aldermen Ponto, Berg, Heinrich and Schellinger voting Aye.

A vote was taken on the original motion and carried Ayes 9, No's 4 with Aldermen Ponto, Berg, Heinrich and Schellinger voting no. Resolution No. 6756*


COUNCIL AS A WHOLE

Alderman Garvens moved approval of the Resolution authorizing commitment of local funding match for passenger rail station improvement grant program. The motion was seconded by Alderman Heinrich and carried unanimously. Resolution No. 6757*


Alderman Garvens moved approval of the Mayor's Appointments. The motion was seconded by Alderman Heinrich and carried unanimously.

Brookfield Convention and Visitors Bureau Dan Waffenschmidt - two year term expiring May 15, 2003

Police and Fire Commission Kimry Johnsrud - five year term expiring May 1, 2006 (reappointment).


Alderman Waffenschmidt moved to adjourn. The motion was seconded by Alderman Bauer and carried unanimously. 10:45 p.m.
